Automatic enrolment declaration of compliance terms and conditions

 

By entering your details in the fields requested, you enable The Pensions Regulator and its service providers to provide you with the automatic enrolment declaration of compliance service (‘the service’). By accessing The Pensions Regulator’s online services you agree to be bound by these terms and conditions which apply to the services we provide, and those which apply to The Pensions Regulator’s website.

Any information you provide to The Pensions Regulator will only be used by us, our agents and service providers and will not be disclosed unless we are obliged or permitted by law to do so.

In particular you agree that we may:

  • use the information you provide in the service for any part of our dealings with you in relation to any other services for which you are declared
  • change, withdraw or add to the service and related website content (or their features) or change the way in which you may access the service, all without notice
  • revise these terms and conditions from time to time as we develop the service and website content (see changes to the terms and conditions)
  • use information from the service in connection with any of our statutory functions. 

Service availability

While The Pensions Regulator shall endeavour to make this site available at all times, The Pensions Regulator will not be liable if, for any reason, the site is unavailable for any period of time. As the declaration is a statutory requirement you should contact The Pensions Regulator without delay if, for whatever reason, the service is unavailable or you are unable to access the service to complete your declaration.

Data Protection Information

The Pensions Regulator is a data controller for the purposes of the General Data Protection Regulation (‘GDPR’) and the Data Protection Act 2018. We will process your personal data pursuant to any of our statutory functions and objectives.

The provision of the information required in the declaration of compliance is a legal obligation under the Pensions Act 2008. Failure to complete and submit your declaration of compliance may lead to enforcement action.

Where you provide personal data of another individual we ask that you ensure you have the necessary consent or authority to do so.

We may share information about you with other government departments or public bodies but not before conducting a data protection impact assessment to ensure your rights are protected. We do not sell, share or supply personal data for commercial purposes.

We will only store your personal data for as long as The Pensions Regulator’s retention schedule allows. During this time, you may be able to exercise certain rights in relation to your personal data such as the right to access, objection and data portability. If you feel that we have handled your personal data in a manner inconsistent with your rights, you may lodge a complaint with the Information Commissioner’s Office (‘ICO’).
